Having in mind the interest in the procedures for the protection of intellectual property rights in Montenegro, below we inform all interested parties about the documentation necessary for taking actions (such as renewal of trademarks, validation of European patents etc.) before the PTO :
VALIDATION OF EP :
1. Signed Power of Attorney (original wet ink signature, no notarization/legalization is required)
2. Patent claims and drawings translated into the Montenegrin language
NEW TRADEMARK APPLICATION :
1. Name and address of the applicant
2. The appearance of the mark
3. List of goods and services
4. Signed Power of Attorney (original wet ink signature, no notarization/legalization is required)
TRADEMARK RENEWAL :
1. Signed Power of Attorney (original wet ink signature, no notarization/legalization is required)
CHANGE OF NAME/ADDRESS TRADEMARK :
1. Signed Power of Attorney (original wet ink signature, no notarization/legalization is required)
ASSINGMENT TRADEMARK :
1. Signed Power of Attorney by assignee (original wet ink signature, no notarization/legalization is
required)
2. Proof of the legal basis of the assignement – deed of assignement or statement on the transfer of rights
signed by the assignor and assignee, in the original or a certified copy, which will have to be translated
into the Montenegrin language by an court interpreter. In these cases, we suggest the parties to sign a
bilingual deed of assignment that our office would provide, in order to avoid translation costs.
